Please read and be certain you understand the implications of submitting this document.

By typing my name below I, the responsible party, acknowledge that participation in any hiking or any other outdoor activity carries with it inherent risks including, but not limited to:

Risk of injury or death.
Fatigue chill, and/or dizziness, which may diminish my/our reaction time and increase the risk of an accident.
All "acts of nature," including but not limited to avalanche, rockfall, inclement weather, thunder and lightning, severe and or varied wind, temperature, and other weather conditions.
Risks associated with crossing, climbing, or down-climbing of rock, snow, and/or ice.
Risks associated with river crossings, fording, or portaging.
Possible equipment failure and/or malfunction of my own or others' equipment, which may have been rented, borrowed or personally owned.
My own negligence and/or the negligence of others, including employees, agents, independent contractors, or representatives of The FACTS Initiative.
Cold weather and heat-related injuries and illness including but not limited to frostnip, frostbite, heat exhaustion, heatstroke, sunburn, hypothermia, and dehydration.
Attack by or encounter with insects, reptiles, and/or animals.
Accidents or illnesses occurring in remote places where there are no available medical facilities.

I, the responsible party, freely accept and fully assume all such risk(s). It is the responsibility of each participant to familiarize themselves with the risks of hiking and other activities. The FACTS organizers and will not assume liability in respect of any of these risks, dangers, hazards, and liabilities. Participants further acknowledge that it is their responsibility to ensure that they carry adequate medical, extended health, dental, and accident insurance coverage, as well as protection for personal possessions. It is the participants’ individual responsibility to verify that they are in good health and are physically capable of carrying out the scheduled activities. I am aware that the members of The Facts Initiative, acting as coordinators of activities, are not professional leaders, guides, licensed first aid attendants, and have not completed an outdoor leadership course or have first aid ( including wilderness) training or experience in either and are not responsible for my safety or that of any children and/ or pets I bring while participating in such activity. I am aware that other participants are not responsible for my safety or that of any children and/ or pets I bring.

Release of Liability, Waiver of Claims and Indemnity Agreement

In consideration for being permitted to participate in any way in hiking and related activities, I hereby agree, acknowledge, and appreciate that: I HEREBY RELEASE AND HOLD HARMLESS WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY NEGLIGENCE OR OTHERWISE, The FACTS Initiative. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, AND I FULLY UNDERSTAND ITS TERMS AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SUBMITTING THIS FORM, AND I SUBMIT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
